TERMS OF USE
ACCEPTANCE OF TERMS
By accessing or using the Qurkle mobile application (the “App”) or any related services (collectively, the “Services”) including AI-powered matchmaking/chat and in-App event ticketing and attendance provided by Qurkle Social Pvt. Limited (“Qurkle”, “we”, “us” or “our”), you (“you” or “User”) agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms in their entirety, you must immediately discontinue your use of the App and Services.
ELIGIBILITY
You must be at least eighteen (18) years of age to register for or use the Services.
Including the matchmaking/ chat features and to RSVP for event tickets. Moreso, each event shall include explicit terms to which the user shall be bound. By creating an account, you represent and warrant that you satisfy this age requirement ‘or’ specific age requirement for any specific event that the user wishes to attend and that you are legally capable of forming a binding contract.
Qurkle does not knowingly collect or solicit personal data from individuals under the age of 18. If Qurkle becomes aware that it has inadvertently collected data from a minor, such information shall be promptly deleted in accordance with applicable child data protection laws in India and global standards.
REGISTRATION AND ACCOUNT CREATION
To register, you must provide a valid mobile phone number and successfully complete OTP‐based verification. During registration you will be required to submit personal details including your name, date of birth, height, workplace, residential and work locations, email address, Instagram username, a real‐time selfie for verification, and at least three (3 or more) profile photographs. You agree to provide accurate, current, and complete information and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
USER RESONSIBILITY AND CONDUCT
Whether interacting through AI chat or attending a Qurkle event, you agree not to harass, stalk, defraud, or otherwise harm any other user. The user agrees not to do any kind of illegal activities whatsoever, on the app as well as the event, they may attend. All matchmaking/chat messages must comply with respectful‑speech standards; any report of abuse or threat may lead to immediate suspension from both chat and event services. Similarly, event attendees must abide by on‑site conduct rules; Qurkle may remove violators from an event and bar them from future chat or event access.
Qurkle’s community standards, while not presently codified as a separate document, are embedded within these Terms. Users are expected to engage respectfully, refrain from abusive or discriminatory conduct, and abide by lawful behavior across matchmaking and event-related interactions. Qurkle reserves the right to release separate Community Guidelines in the future, which shall be binding on all Users upon publication.

PAYMENTS AND SUBSCIPTIONS
Qurkle offers premium matchmaking services and event specific upgrades which may be accessed through in-app purchases. All payments for such subscriptions and add-ons are presently processed through the Apple App Store and Google Play Store. Qurkle also reserves the right to introduce additional payment methods, including direct integration with authorized payment gateway, for facilitating future transactions. By initiating a purchase, the User acknowledges and agrees that all premium subscription plans operate on an auto-renewal basis unless expressly cancelled by the User prior to the commencement of the next billing cycle. No refunds, partial credits, or adjustments shall be issued for periods of non-usage, mid-cycle cancellation, or unutilized features, except where mandated by applicable law. Where the User elects to purchase event-related enhancements such as VIP access, premium experiences, or exclusive sessions the User understands that such purchases are deemed final and non-refundable beyond the permitted cancellation window. If the User cancels an event booking at least twenty-four (24) to forty-eight (48) hours prior to the event start time, the User shall be entitled to a refund of fifty percent (50%) of the ticket price. No refund shall be provided for cancellations made after this time window. In the event that Qurkle cancels or reschedules an event, the User shall be entitled to a full refund, which will be processed to the original payment method.
In instances where a transaction is identified as fraudulent, disputed, reversed, or associated with misuse of promotional offers, Qurkle reserves the absolute right to suspend or terminate the User’s access to both subscription features and event services. Such action may be taken at the sole discretion of Qurkle and may include permanent deactivation of the User’s account without further obligation to the User, including any obligation to refund.
CONTENT OWNERSHIP AND MODERATION
All content submitted, uploaded, or otherwise shared by the User on the Qurkle platform including but not limited to profile images, biographies, chat conversations, voice recordings, and photographs or videos taken during Qurkle events shall remain the intellectual property of the User. However, by making such content available on or through the App, the User grants Qurkle Social Pvt. Limited a worldwide, perpetual, non-exclusive, royalty-free, irrevocable, and sublicensable license to use, reproduce, modify, adapt, display, publish, and distribute such content for purposes connected with matchmaking, feature enhancement, platform analytics, promotional communications, and marketing of events.
In addition, Qurkle retains full rights to capture, create, and process any content it produces or facilitates including but not limited to event after movies, photos, video footage, or other media recorded by or on behalf of Qurkle during its events. Qurkle may use such content for any purpose it deems appropriate, including but not limited to marketing, AI training, personalization of user experiences, distribution to users featured in such content, and promotional or internal research purposes.
Qurkle maintains the right, but not the obligation, to moderate all User-generated content using automated tools, AI filters, and manual moderators. This applies equally to content transmitted through in-app chat, content uploaded to the User’s profile, and content visible or disseminated in relation to Qurkle’s offline events. Any content that is determined by Qurkle, in its sole discretion, to be offensive, harmful, defamatory, sexually explicit, fraudulent, misleading, unlawful, or otherwise contrary to the platform’s community standards, may be removed without prior notice.
In addition to content removal, Qurkle reserves the right to restrict, suspend, or permanently terminate the User’s access to the App including access to AI-driven matchmaking services and participation in any events where such content violations are detected. Qurkle shall not be liable to the User for any damages, refunds, or loss of access arising as a consequence of such enforcement actions.
THIRD PARTY TOOLS AND TRACKING
Qurkle integrates third-party tools and software development kits (SDKs) necessary for delivering a seamless experience across both matchmaking/chat functionalities and event-related services. These include, without limitation, Google Maps API for location services, mobile SDKs for usage and performance analytics, crash reporting tools, and third-party payment gateways for in-app ticketing and subscriptions.
By accessing or using the Qurkle platform, the User expressly consents to the collection, storage, and processing of data by these third-party providers, to the extent necessary for the operation and optimization of both core matchmaking features and event functionalities. Qurkle does not control how such third parties may process data beyond the scope of integration but undertakes to ensure that all tools used are compliant with applicable privacy and data protection standards.
ADVERTISMENTS AND THIRD PARTY CONTENT
The Qurkle App and Services may contain links to third-party websites, promotions, SDKs, content feeds, payment portals, event partner microsites, or other external services (“Third-Party Content”) that are not owned or controlled by Qurkle Social Pvt. Limited. Such Third-Party Content may be presented in the form of banner advertisements, event listings, sponsored placements, or functional integrations necessary for location, payments, analytics, or user interface optimization.
From time to time, Qurkle may display logos, names, or branding of its event partners (such as Red Bull, Sony, or similar collaborators) on event listings, posters, or related content. Such material may qualify as general promotional content but does not constitute targeted advertising or personalized marketing. Qurkle does not use ad tracking or behavioral profiling to serve advertisements, nor does it operate as an ad platform or integrate with third-party ad networks for targeted advertising purposes.
Where a User chooses to interact with a third-party offering including by clicking on an external link, making a payment through a third-party gateway, or engaging with a sponsored event the terms and conditions, privacy policies, and service standards of that third party shall apply. Qurkle shall not be responsible or liable for any loss, damage, dispute, or claim arising out of or in connection with the User’s dealings with third parties accessed through the App.
The inclusion of third-party links, promotional branding, or advertisements does not imply Qurkle’s endorsement or recommendation of the third party, nor does it create any agency, partnership, or employment relationship. Users are encouraged to independently verify the credentials, claims, and terms of any third-party offering before engaging with them. While Qurkle may monitor integrations for basic compliance and security, responsibility for interactions with third-party content rests solely with the User.
SECURITY MEASURES
Qurkle employs industry-standard security protocols to protect all data transmitted, stored, or processed through the platform. All personal data, including chat transcripts, profile images, and event RSVP information, is hosted on secure servers located in India and managed through trusted cloud service providers such as AWS, MongoDB Cloud, Firebase, and others.
The User acknowledges that no digital system is entirely immune from risks such as unauthorized access, breaches, or service disruptions. Qurkle shall not be held liable for any damages or losses resulting from such events, provided that the company has acted in accordance with industry-accepted security practices and has not engaged in willful misconduct or gross negligence.
TERMINATION AND SUSPENSION
Qurkle reserves the right to suspend or permanently terminate the user’s account at its sole discretion in the event of a breach of these Terms or any applicable law. Grounds for termination include but are not limited to misuse of the AI chat interface, violation of content standards, fraudulent activity, disruptive conduct at events, and harassment or abuse directed at other users or persons, either online or in person. Suspension may include temporary or permanent revocation of access to premium matchmaking services, chat capabilities, participation in upcoming events, or the ability to purchase event tickets or subscriptions.
Upon termination, the user shall have no further right to access any feature of the App, and shall be under no obligation to refund any remaining subscription term, event fees, or other paid services. Clauses relating to intellectual property, disclaimers, limitations of liability, and dispute resolution shall survive the termination of the user’s account.
DISCLAIMERS AND LIMITATION OF LIABILITY
Qurkle provides the App, its Services, including matchmaking suggestions, AI-powered chat functionality, event listings, ticketing infrastructure, and all related content and features, on an “as is” and “as available” basis. To the fullest extent permitted under applicable law, Qurkle makes no warranties, guarantees, or representations whether express, implied, statutory, or otherwise regarding the reliability, security, fitness, accuracy, or suitability of the Services for any particular purpose.
Qurkle does not guarantee that the services will be uninterrupted, timely, secure, or error-free. Qurkle does not warrant that any errors or defects will be corrected or that the content, recommendations, or matches generated by its GPT or other algorithms will be accurate, meaningful, or compatible with the User’s preferences or intentions. Qurkle disclaims all liability for interruptions due to technical failures, server outages, latency, bugs, viruses, or system-related issues.
Furthermore, Qurkle does not guarantee the number, quality, or availability of active users, nor the willingness, availability, or conduct of any User to engage in communication or attend events. All matches, interactions, conversations, and meetings are undertaken at the User’s sole discretion and risk. Qurkle shall not be responsible for the success or outcome of any interaction whether generated through AI models or facilitated during a Qurkle-hosted event.
Qurkle assumes no responsibility for content posted, submitted, or shared by Users through the App, including bios, photographs, chat messages, or content shared during events. The identity, veracity, or intent of any User cannot be fully verified, and Qurkle shall not be held liable for any damages or losses resulting from false representations, harassment, impersonation, miscommunication, or User negligence.
Use of the Services implies that the User bears sole responsibility for safeguarding their devices, data, and communications. Qurkle disclaims any liability for damage caused to the User’s device, software, files, or network resulting from use of the App or any third-party integrations, including payment SDKs, location APIs, or analytics tools.
Users are urged to exercise judgment, avoid sharing sensitive personal data, and follow all applicable laws, safety advisories, and platform guidelines. Qurkle does not substitute such precautions with any automated safety filter or real-world vetting process.
Qurkle does not guarantee the success, compatibility, or outcome of any matchmaking interaction, nor does it guarantee the User’s experience at any event. The user assumes all risk associated with in-person meetings, attendance at events, or reliance on AI-based interactions or communications.
To the maximum extent permitted under applicable law, Qurkle’s aggregate liability for any and all claims arising under or related to the Services, whether pertaining to matchmaking, chat, or event participation shall be limited to the total amount paid by the user to Qurkle in the preceding six (6) months. Qurkle shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including personal injury, loss of data, or emotional distress, whether occurring online or at physical offline events.
INTELLECTUAL PROPERTY
All intellectual property associated with the Qurkle platform including but not limited to its name, logo, branding, AI algorithms, matchmaking framework, user interface, event management tools, and any associated code or media are the exclusive property of Qurkle Social Pvt. Limited. These are protected under applicable intellectual property laws in India.
The user is granted a limited, non-transferable, non-sublicensable, revocable license to access and use the Qurkle platform solely for its intended purpose namely, social connection via AI matchmaking and participation in curated events. The User shall not reverse-engineer, duplicate, distribute, publicly display, reproduce, or exploit any proprietary content of Qurkle without prior written consent by the Qurkle team.
Unauthorized use or reproduction of Qurkle’s intellectual property may result in legal action, including injunctive relief, damages, and termination of access to the App and all associated services.
GRIEVANCE REDRESSAL
Qurkle maintains a formal grievance redressal mechanism in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Users who wish to raise a complaint regarding any aspect of the Services including issues related to chat interactions, AI behavior, user conduct, or event experiences may do so by writing to this email id : support@qurkle.com.
All complaints will be acknowledged within seven (7) business days of receipt and will be investigated and addressed within a maximum period of thirty (30) days from the date of acknowledgment. Mr.Shubham Muthreja, director of the said company is the designated Grievance Officer, all such correspondence shall be directed to the email address above. The grievance mechanism covers both online and offline service experiences.
DATA RIGHTS
The User has the right to request access to their personal data maintained by Qurkle, including but not limited to chat transcripts, AI interaction history, account details, and records of event participation. The User also retains the right to request deletion of such data, subject to applicable legal retention requirements.
All verified data deletion requests will be honored within a maximum period of sixty (60) days from the date of successful identity verification. For security and compliance purposes, Qurkle may retain anonymized or aggregated data even after account deletion.
Accounts that remain inactive for a continuous period of twelve (12) months meaning no use of the matchmaking/chat interface or attendance at any events will be flagged for removal, and the associated data may be permanently deleted or anonymized at Qurkle’s discretion.
GOVERNING LAW AND DISPUTES
These Terms shall be governed by and construed in accordance with the laws of the India. Any disputes arising out of or in connection with the use of the Qurkle platform whether pertaining to the AI matchmaking services, chat features, or events shall first be attempted to be resolved amicably through mediation. In the event mediation fails, the matter shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
The seat and venue of arbitration shall be decided on a later basis, and the language of the proceedings shall be English. Subject to the above, the courts of Faridabad, Haryana shall have exclusive jurisdiction over any remaining disputes.
FORCE MAJEURE
Qurkle shall not be held liable for any failure or delay in
performance of its obligations under these Terms, including the hosting
of events or delivery of digital services, where such failure or delay
results from circumstances beyond Qurkle’s reasonable control,
including but not limited to acts of God, natural disasters, pandemics,
labour strikes or bandhs, internet outages, governmentuseral actions,
venue closures, or any other unforeseen external events.
INDEMNITY BY USER
The user agrees to indemnify and not hold Qurkle Social Pvt. Limited, liable, its affiliates, directors, officers, employees, agents, successors, and assigns from any claims, liabilities, demands, losses, damages, costs, or expenses, including reasonable legal fees, arising out of or in connection with the User’s access to or use of the Qurkle App and Services. This includes, without limitation, the User’s conduct on the platform (whether via matchmaking, AI chat, or event participation), the content submitted by the User (such as messages, bios, or photographs), any misrepresentation made by the User, or breach of these Terms of Use, Privacy Policy, or any applicable law or regulation.
This indemnity extends to claims brought by other users or third parties arising out of User behavior whether online in AI-assisted chat or offline at any Qurkle event. In the event of such a claim, Qurkle reserves the right to assume exclusive defense and control of the matter at its sole discretion, and the User agrees to cooperate with Qurkle in asserting any available defenses. This clause shall survive the termination of the User’s account or cessation of their use of the Services.
NO CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS
Qurkle Social Pvt. Limited does not conduct criminal background checks, sex offender registry screenings, or identity verification through government databases at the time of user onboarding or account activation. While Users are required to upload a real-time self-portrait image (selfie) and complete a basic verification flow within the App to ensure authenticity of visual identity, this process does not constitute a legal identity verification or a background check.
Qurkle does not make any representations or warranties, whether express or implied, regarding the personal history, conduct, mental or physical condition, moral character, intentions, or legal status of any User. Users are advised to exercise discretion, judgment, and caution when engaging with other Users, whether via AI chat, voice note exchanges, or during offline events curated by Qurkle. By creating an account and using the App, the user authorizes Qurkle, at its sole discretion and at any time, to conduct limited background screening using publicly available information or through authorized agencies if required for legal, regulatory, or safety reasons. However, Qurkle assumes no obligation to undertake such checks unless mandated by law or ordered by a competent authority. If such screening is conducted through any third-party consumer reporting agency, the User expressly consents to Qurkle accessing and evaluating the results solely to assess compliance with Qurkle’s Terms and Safety Standards.
Users are solely responsible for their own conduct and for interactions with others, including decisions to meet offline or share personal contact information. Qurkle disclaims liability for any damages, harassment, fraud, or harm resulting from User interactions, whether through chat, events, or any other features of the platform. Use of in-app communication tools including AI chat or match suggestions does not guarantee a user’s suitability, compatibility, or intent.
While Qurkle strives to foster a respectful and safe user environment, it cannot control the actions or disclosures of individual users and shall not be liable for any misconduct occurring either on the platform or during offline events. Users are expected to review safety guidelines provided within the App and adhere to reasonable precautions at all times.
AMENDMENTS
Qurkle reserves the right to modify, update, or revise these Terms at any time, to reflect changes in platform functionalities, AI technologies, or event operations. Any material changes will be notified to the user via email or through prominent in-app notifications.
Continued use of the platform after such notice shall constitute the User’s acceptance of the revised Terms. The User is encouraged to periodically review these Terms to remain informed about their rights and obligations.
ENTIRE AGREEMENT
These Terms of Use, in conjunction with Qurkle’s Privacy Policy, and any notices or guidelines posted within the App or communicated via email including but not limited to subscription pricing, event refund policies, and chat moderation rules constitute the entire legal agreement between the User and Qurkle Social Pvt. Limited. This agreement supersedes all prior understandings, communications, and arrangements, whether oral or written, relating to the Services.
If any provision of these Terms is determined to be unlawful, void, or for any reason unenforceable under applicable law, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The failure of Qurkle to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless expressly stated in writing and signed by an authorized representative of Qurkle.
The User agrees that their Qurkle account is personal, non-transferable, and terminates upon death unless otherwise required under law. The User may not assign or delegate their rights under these Terms without prior written consent from Qurkle. Qurkle may assign or transfer its rights and obligations under these Terms without restriction or notice to the User.
Nothing in these Terms shall be construed as creating a partnership, joint venture, fiduciary, or employment relationship between the User and Qurkle. The User shall have no authority to bind Qurkle in any manner or make representations on its behalf.
